Privacy Policy for the Processing of Personal Data Pursuant to Article 13 of Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR)

These provisions do not apply to other websites, pages, or online services accessible via hyperlinks that do not pertain to the Data Controller.

1.DATA CONTROLLER AND DATA PROCESSOR

2. CATEGORIES OF PERSONAL DATA PROCESSED The data we process includes:

  • User's Personal Data (name, surname, email, phone number, etc.). The voluntary, explicit, and optional sending of messages to the Data Controller’s contact addresses, as well as the filling out and submission of forms on the Data Controller’s website, following your explicit consent, will result in the acquisition of your contact information and any personal data included in the communications.
  • Browsing Data. The computer systems and software procedures used to operate this website acquire, during their normal operation, personal data whose transmission is implicit in the use of Internet communication protocols, as well as personal data following your explicit consent.
  • Data collected through cookies during the user's browsing activity on the site. For further details regarding the cookies used by the web portal or the sites that constitute its system, please refer to the extended cookie policy in the footer and/or the main page, where consents can also be managed.


3. PURPOSES OF DATA PROCESSING

Personal data is processed within the scope of the Data Controller’s activities for the following purposes:

  • To provide the user with the requested information;
  • With prior consent, for profiling and personalization;
  • With prior consent, for advertising purposes;
  • With prior consent, to enable browsing of the website;
  • With prior consent, to gather information about the use of the website and related services, to ensure its proper functioning, to conduct monitoring activities to support its security, and to identify actions aimed at its improvement (for browsing data);
  • To comply with legal obligations, to respond to orders from Public Authorities, to ascertain any responsibilities in the event of hypothetical computer crimes against the site or its users.


4. LEGAL BASIS FOR PROCESSING

Personal data is processed by the Data Controller as one or more of the following conditions apply (Art. 6 GDPR):

  • The data subject’s consent pursuant to Art. 6, para. 1, GDPR;
  • Processing of data for the prevention or suppression of fraud and any illegal activity;
  • Compliance with obligations under the law, regulation, EU legislation, or an order from an Authority (Art. 6, para. 1, letter c, GDPR);
  • The provision of data for the purpose of responding to the User's requests is necessary and therefore mandatory.
  • The provision of data for other purposes, and thus consent to the collection and processing of data, is optional.
  • The User may refuse consent and may withdraw any previously given consent at any time. However, refusal of consent may make it impossible to provide certain services, and the browsing experience on the website may be partially compromised.



5. DATA RETENTION PERIOD

The Data Controller will process the data for the time necessary to fulfill the purposes mentioned above:

  • Data processed for contact and/or information requests from you will be retained for the time strictly necessary and, in any case, for no more than three (3) months from the last contact;
  • Data collected through cookies will be retained for no longer than the period specified in the separate extended cookie policy.

Your data will be processed using appropriate electronic and/or telematic tools, in compliance with the legal provisions on personal data processing, adopting suitable security measures to ensure the security and confidentiality of the data.

8. CATEGORIES OF RECIPIENTS AUTHORIZED TO PROCESS DATA AND WHO DATA MAY BE DISCLOSED TO

The data will be processed by employees and collaborators of the Data Controller in their capacity as appointees and/or authorized persons and/or system administrators, by Public Security Authorities or other public entities for defense, State security, and crime detection purposes, or by the Judicial Authority in compliance with legal obligations, where crime is suspected, as well as by any external parties identified as Data Processors pursuant to Art. 28 GDPR, whose updated list is always available from the Data Controller, which you may request via email.
Your data will not be disclosed, except to fulfill obligations provided by law or regulations.

9. TRANSFER OF DATA ABROAD

Your data may be processed by natural and/or legal persons acting on behalf of the Data Controller under specific contractual agreements and based in EU or non-EU countries.
Your data may be transferred to Third Countries deemed adequate by a decision of the European Commission (Art. 45 of Regulation (EU) 2016/679). To obtain a list of Third Countries, you can contact the Data Controller via email at info@litix.com.
If data is transferred outside the European Economic Area (EEA) and adequacy is not recognized, the Data Controller will adopt all appropriate contractual measures to ensure adequate data protection.



10. DATA SUBJECT'S RIGHTS

With regard to your data, you have the right to request from the Data Controller, following the procedures outlined in the Regulation:

  • Access, in the cases provided (Art. 15 GDPR);
  • Rectification and completion of inaccurate data and integration of incomplete data (Art. 16 GDPR);
  • Erasure of data for the reasons provided, such as when it is no longer necessary for the purposes indicated above or not processed in accordance with the Regulation (Art. 17 GDPR);
  • Restriction of processing in the cases provided by Art. 18 of the GDPR (Art. 18 GDPR);
  • As processing is based on consent and carried out by automated means, you have the right to data portability, i.e., the right to receive, in the cases provided, in a structured, commonly used, and machine-readable format, the data concerning you and, if technically feasible, to transmit it to another controller without hindrance;

You also have the right to:
  • Object to processing, in the cases provided (Art. 21 GDPR);
  • Withdraw consent previously given.


At any time, you may lodge a complaint with the Data Protection Authority, as well as resort to other remedies provided by applicable law.

11. EXERCISE OF RIGHTS

You may exercise your rights by writing an email to info@litix.com.

No particular formalities are required, and you can use the form published on the Privacy Authority’s website at the link https://www.garanteprivacy.it/home/diritti/come-agire-per-tutelare-i-tuoi-dati-personali.
The response time is one (1) month, extendable by two (2) months in case of particular complexity. In such cases, the Data Controller will inform the data subject within one (1) month of receiving the request.
The exercise of rights is, in principle, free of charge, except for the right to request a contribution in the case of manifestly unfounded or excessive (including repetitive) requests.


12. RIGHT TO COMPLAIN

If you are not satisfied with our response, you can lodge a complaint with the Data Protection Authority (Garante per la protezione dei dati personali) using the method you consider most appropriate:

  • Certified email sent to protocollo@pec.gpdp.it (this address is configured to receive ONLY communications from certified email addresses);
  • Registered letter with return receipt addressed to: Garante per la protezione dei dati personali, Piazza Venezia, 11 - 00187 Rome;
  • Hand delivery at the offices of the Garante per la protezione dei dati personali, Piazza Venezia, 11 - Rome.
